I think after the furore surrounding this issue the wings must be legal (in respect that it meets the criteria laid out by the rule book!). However, it is inevitable that the structure will deform under load, this is also permitted in the rules as they permit a maximum deflection under a given load. Clearly it is desirable to let the wing deform in that way an the teams are working around the regulations to comply with the rule book, yet still give optimal performance. Another example of compy with the letter of the law (and leave the spirit of the law to the losers!)
Bodywork may deflect no more than 5mm vertically when a 500N load is applied vertically to it
There is no question that the stewards are measuring the wings (e.g. both MF1's disqualified after Germany for excess flexing of the rear wings).

Personally I did not notice the Ferrari wing movement (perhaps selective blindness!!!), but I did notice the trailing edge of the Renault wing deforming at high speed, the camera angle was quite convenient to permit reference points on the edge of the screen. However, on thing I did notice on the Super Aguri was the trailing edge of the rear wing end plate flapping like a fish tail - it really appeared very flexible. On any other team I would be inclined to think that this was intentionally designed that way (vortex shedding?), but on SA... perhaps they just an out of CF and resin!
