I am not an attorney, but I do employ a few, I would imagine that it wouldn't be hard to prove that the car or team is not sponsored by or advertising for Marlboro. Remeber, common sense is rarely used inside a courtroom.
I also read that the Marlboro deal was basically a VIP/Executive package allowing them access to Ferrari and entertain their execs/guests. That could easily be used in court as the reason for the money.
I don't know how the exact law reads (anybody have a link?), but in the states you simply can not advertise the tobacco product, there is no law against contributions (to politicians, race teams, concerts, car shows, etc).
I guess all politicians who take tobacco lobby money should be fined as well?
Once again, why not solve the real problem, the product. If people were serious about all this the product would simply be banned. I don't smoke, nor would I ever, I am to smart for that. I don't need a race car to tell me to smoke or a govt to tell me not to smoke, yet as long as the product is legal, I see the ban on advertising it silly.
