Van der Garde referred to a British judge

Giedo van der Garde will have to take his case against Force India to a British judge. The court in the Dutch city of Breda declared a week and a half ago, on 20 June, that they are not competent to rule on the matter. Van der Garde and his financier, Marcel Boekhoorn, are demanding 2 million dollars from Force India as his test contract with Spyker was not fulfilled.

Force India declared that they have already offered several compromises but that van der Garde and Boekhoorn don't want to hear of it. Colin Kolles said to the Dutch newspaper 'Algemeen Dagblad': "We have attempt several times to regulate the matter friendly. All those compromise proposals have been rejected. Boekhoorn only wants his money back and doesn't want to know about any other arrangement. Well, then he and van der Garde must go to a British judge."

In 2007, van der Garde and Boekhoorn payed 3 million dollar to drive 6000 testing kilometres, but the Dutchman only drove 2000. Now van der Garde wants 2 million dollars from Force India as this is 2/3 of the payed amount and he only got to test 1/3 of the agreed testing mileage.

According to Kolles, the team will never pay this amount of money as van der Garde has deliberately kept important information to himself during the signing of the contract with Spyker. The Dutchman already signed a contract with Super Aguri, but he signed a contract with Spyker in which he declared that he didn't have a contract with another team.
