Do the rules state that the flap must be ‘still’ when operated? To my knowledge the DRS flap is specifically excluded from the rules about moving aerodynamic devices (obviously, as by its very definition it is a moving aerodynamic device!!). There must be a minimum slot gap when closed, with a maximum slot gap when open.

I’m not entirely sure how you could regulate around this without simply outlawing DRS.

For all those that believe Mercedes to be whiter than white when it come to regulations, don’t forget that double-DRS used to be a thing, they came up with that and it worked quite effectively! It forced a re-interpretation (a TD…), and was banned.
Everyone is trying to take advantage of the grey areas; that is where championships are won and lost. None of them are above using red-herrings to throw other teams off the scent of where they are gaining advantages. All of them will argue that their interpretation is completely legal until proven wrong.
Whatever either RBR or MB may or may not have been doing with wings this season- none of it is cheating as far as I’m concerned. It’s all exploring grey areas and innovative solution.
Definitely a penalty, given the precedence, they always give penalties for this. But if Verstappen gets one then Bottas will also get one for not slowing down during yellow. FIA gave penalty to Vettel in Bahrain for 5 place grid drop for single waved yellow. In Austria 2020 Lewis also did not have any change in his steering wheel, it was just the marshal post with double yellow and he still got 5 place drop.
Again, I recall a similar situation explaining that the electronic system has lag and may not always be reliable. Therefore on track flags must be adhered to.

Yes flags > lights but now someone has to look through all the footage. If it were yellow on the system you might get auto-reported. Idk for sure if it works this way though.
