Car 1 also has a responsibility to overtake without causing a collision.

Divebombimg into an impossible-to-turn-in position at the apex, doesn't do that.

where were you saying this very same thing in Silverstone when Lewis punted Max off?

Lewis didn't. Max went for the corner on the racing line, heading for the apex. Lewis was partially alongside and went to back out but didn't get back out enough before max cut across him. For that incident I said that if max gave ham half a cars width there wouldn't of been a collision.
