HRT did it year after year with their chassis. As long as the car complies with the regulations of that year, nobody can veto against it.
For the record, the car they are prepping now will also be legal next year. Not that they will continue with it since I don't even think they can get through the 107% rule in Melbourne. Plus the chassis will be incompatible with newer Ferrari PU's, and Ferrari will not be bothered to continue producing 2014 specs.
They have a hacked at 2014 chassis modified to be legal, but running an obsolete engine and an obsolete braking system, so as said, they will have to produce a new car internally for next season.

They don't need to design a new car, as shown in the car thread, Marussia were already well down the line with the design of a car and had countless iterations of wings, diffusers etc all wind tunnel tested. All that data will be at the new teams disposal.
