First it will be illegal since its a moveable aero device
Second, it seems it moves in reaction to acceleration. This means that it will react too late to fast corners where there is not much braking

As far as i can see it is also g-operatet so that it is not a problem in fast corners. the g-forces keeps the switch open.

But yes this would go under movable aero so this is not legal.
