Star witness in Mosley case not able to testify

The leading witness in the Mosley court case against 'News of the World' withdrew herself. Woman E, who sold her story to the newspaper, is said to have reached an "emotional and mental state which is such that it would not be fair or reasonable to call her to give evidence."

The prostitute, woman E, secretly filmed the SM session in which Max Mosley participated in March. She was due to give evidence at the court today together with her husband. As she was unable to testify today, the case was adjourned until Monday for counsel to prepare their closing speeches.

Mr Mark Warby, QC for the newspaper, said: "I have received information which has later been elaborated on which leads those instructing me and my clients to take the view that her emotional and mental state is such that it would not be fair or reasonable to call her to give evidence."

Woman E would testify that instructions were given to her by woman A, which originated from Max Mosley, about a Nazi theme. Warby continued: "We will not persist in that case. It is a most regrettable situation to have arrived at."
