It's not that simple, because the cars will still have lots of generalized aero carry over. For example engine cover shaping, nose stuff etc. For stuff like that the FIA has no way of knowing what car the work is ultimately intended for.

What I remember, Mercedes stopped the normal development of their 2020 car as soon as it was clear that they had a good enough lead (around the first few races) and had their 2021 car ready later that season. They made sure that as much of the costs for 2021 could be booked in 2020 and go next level with efficiency, as going so far as not only using the same chassis designs, but the actual chassis.

During the 2020 season, aero work for 2022 was banned, but the rest wasn't. In theory they could have had a few rolling chassis of the 2022 car in 2020 on the basis of the early aero work before the freeze, and picking up full speed in jan 1 2021.
Of course, most teams, especially the top teams did this in some extent, but the lead Mercedes had in 2020 possibly give them an extra advantage going into 2022.
