Yes, disqualification is a real possibility as the scrutineers and FIA will/can now only examine it after the event.
As was pointed out at the time the FIA have only set out certain times that the protest can be lodged. What Brawn was bitching about, and quite rightly, was Red Bull saying race after race that they were going to protest but then didn't do anything. They just kicked up a fuss in the media and asked the FIA for clarification.

I mentioned this in the RBR thread but got the response that it wasn´t techincally a hole.

Christian Horner says that it is 100% totally watertight and legal in an interview with Ted Kravitz, also that the FIA have said it's fine.

Could Red Bull put duct tape over it for the race, is that allowed??? Or is that only if there is a change of climactic conditions?

possibly at a pitstop as arent they under parc ferme until the lights go out?
