If the suspension is illegal due to §10.5.3 it has nothing to do with the number of suspension members.
10.5.3 is about the dimensions of the uprights.

§ 10.5.2 is about the number of suspension members allowed.
Dear FIA, if you read this, please pm me for a redesign of the Technical Regulations to avoid finger nose shapes for 2016! :-)

Well, let me rephrase it then: Charley gave his opinion, and until now nobody made an official complaint or claimed it was illegal. Charley furthermore asked, because he is such a jerk, that they change it, just for fun.

Lotus gets DRD race-ready at Silverstone - Development blog

Lotus are set to give 'the device' its race debut at Silverstone. The ducting system, more commonly known as DRD (Drag reduction device) is fitted on Kimi Raikkonen's car. At a time when other teams have seemingly given up all hope of racing it, despite Mercedes, Red Bull and Sauber testing similar designs during winter testing, Lotus is pushing ahead [...]

Racing the device will provide the team with a lot of additional data, especially because Romain Grosjean's E21 is fitted with a new, slim bodywork cover without DRD. If the Great Britain GP would prove to Lotus that DRD is not effective, it may well mean the end of the DRD altogether. We're however not yet at that point, and Lotus have obviously put in some more effort into the system to tune it it work as it should.

Mclaren complained and now the FIA asked them to change it and Lotus says it wont be a massive operation and wont lose them anything.

officially mclaren asked for a clarification actually. Teams put high value on protocol (usually).

I think McLaren need to concentrate on putting stuff on their car that's going to improve performance.

At last Lotus are finally getting some performance use out of those silly 'ears' they had around their airbox.

Seems to me from Lotus´s comments that the new slimmer bodywork is faster than this stupid device:
Romain didn’t have a perfect last lap and suffered from understeer in Turn 15 whilst there didn’t seem to be much more pace in Kimi’s car.

Kravitz mentioned that Kimi is complaining about the rear sliding. Maybe the device is not working 100% as of the moment, but better race it now and learn from it than delay it further...

i always thought this device can only maximize its effect on track like Spa where S1 and S3 depends alot on straightline speed and S2 depends alot on downforce.

No, Spa is the absolute antithesis of a track that would benefit from it. They need the rear wing to be working properly at extremely high speeds at Spa, or S2 will be a wash out. Thus it would need to be tuned to switch at a high speed, and hence have little benefit on the straights.

Monza is basically what you want for a track where the DRD will help you.
