Yes.
Edit: the engine of the Pagani is Mercedes-AMG M158 V12 twin-Turbo.

There is a small wing underneath the bulged suspension arms. Air coming out there must be of very low pressure, further accelerating airflow above the diffuser.

Despite its rough, big and clumsy look it's actually very refined.

Added bonus is that the suspension will act as a fairly effective rear bumper, an obvious reaction to Maldonado's return to the midfield.

Nope, they don't have to.. there is nothing stopping them from designing the car with it and testing it.
He never said they had to, he said they would have, because it's good sense. They did exactly the same thing with the f-duct.

It can see this thing being copied by other teams before even the first race. It ain't too hard to implement.

Apart from the rear mounting point of the suspension arms. That's not going to be quick to replicate.

First you need to know, how much, in the terms of lap time, are those worth. Then you need to know if it is stable/easy to setup and then you can decide if to copy.

Yes it's unique, but is this something what gives you superb performance like EBD does?

Not really, the pagani is active aerodynamics. It reacts to wheel speed, yaw and alot of electronics.
The mclaren's aer...ehemm.m. suspension system, which is a passive system has a wishbone... which manages to deflect air like a wing.

According to his tweets, McLaren are apparently calling this a "mushroom" suspension.
