Why is it the FIA's job to notice these things at a test? The teams are allowed to run illegal parts at tests (they do so all the time, e.g. with pitot tube rakes). Cars only have to comply with crash test rules during testing and free practice. They can try out a lot of variations without worrying if they are legal. Besides the FIA, you have the race stewards, since we're not racing yet, you would expect the FIA to do atleast what they are supposed to do.
Also, Force India were running their 2014 car, which technically is illegal for the 2015 season.
